How Can Drugs and Alcohol Affect My Case?
If someone has a diagnosis of alcoholism or illegal drug use, then social security is under obligation to determine if this is material to the disability. If the person is still using alcohol or drugs social security has to make a decision if the limitations prevent them from doing work. Then if you take out the alcohol or drug use will they still be disabled? If someone has a physical impairment and uses marijuana, it will be hard to for the judge to say the use is material to the drug use. They will have the back pain if they use or not. You have to be completely truthful because the judge may not believe your testimony on the real issue which is the back pain.
