Can Social Security take away my disability benefits?

If Social Security finds me disabled, will they later review my case to see if I’m still disabled? The answer is “maybe.” Social Security conducts “Continuing Disability Reviews,” in which they review cases to see if a person is still disabled. If a disabled person is 55 or older, it is highly unlikely that Social Security will review their case. However, Social Security typically reviews the cases of younger disabled people every 3-5 years.

If you are disabled and learn that Social Security is reviewing your case, Social Security will request the names of your medical providers and your work history since you became disabled. If Social Security decides that you are no longer disabled, you can request a hearing before a Social Security judge. You can also continue to receive your monthly disability benefits while your appeal to the judge is pending. However, if the Social Security judge decides that you are no longer disabled, you might be required to repay Social Security the monthly benefits you received during the appeal.
